1. GENERAL CONDITIONS
These general terms and conditions of sale are agreed between BlueBird, with registered office at Rua Eng.º Ferreira Dias, n.º 924 - 2º andar, Salas E31/E35/E36, 4100-246 Porto, registered at the Commercial Registry Office of Porto, with the Registration and Corporate Identification number 504 609 513, with a share capital of 1 687 000 €, Jewellery Retailer Licence without Establishment no. P330048, hereinafter referred to as "Bluebird" and persons making purchases via the Bluebird Website - www.bluebird.pt are hereinafter referred to as the "User", and the User must always be a non-trading natural person.
Purchases made through this website are governed solely by these general conditions of sale to the exclusion of any conditions previously available on the Website or by prior express written agreement.
BlueBird may modify provisions of its general conditions from time to time, so the User should reread them each time they visit the Bluebird website.
The purpose of these general terms and conditions of sale is to provide and define the information needed by the user and regulate all the steps required to place an order.
2. BLUEBIRD CLIENT CARD
By registering on the site, you accept the terms and conditions of the Bluebird Customer Card presented here .
You join the Bluebird Customer Card loyalty programme after your first purchase.
3. PRIVACY POLICY
The user authorises BlueBird to process and use their data in accordance with the Privacy Policy of the BlueBird website.
BlueBird recognises the importance of protecting your personal data, whatever its nature. Above all, we value honesty and transparency, so that we can build a solid and lasting relationship with our customers, based on trust and mutual benefit. Therefore, with entry into force of the European Union's new General Data Protection Regulation (EU 2016/679), we have developed a set of security measures aimed at protecting your data and have updated our Privacy Policy.

4. ORDER AT WWW.BLUEBIRD.PT
1. To place an order, the user must add items to the shopping basket, edit the quantity of items and finalise the purchase using the "Checkout" option.
2. In order to place an order, the user must:
a) Log in or register on the BlueBird website or opt for "Guest Checkout".
b) Complete the information requested, specifically the delivery and billing address, delivery, and payment methods.
3. The placing of an order by the user represents full and complete acceptance of the prices and description of the products available for sale as well as the general conditions.
4. BlueBird respects order deadlines as long as stock is available. In the event of stock shortages, BlueBird will contact the customer by e-mail or telephone to inform of the new delivery date for the product. If the customer does not agree with the delivery time, they can choose to buy another item or have the amount paid refunded.
5. DELIVERY
Orders are delivered by different carriers contracted by Bluebird. Cost and delivery times can be verified here .
Bluebird undertakes to make every effort to ensure that delivery takes place within the stipulated period.
Products marked as having limited stock and/or products with engraving may have an additional delivery time to that advertised on the site.
In the event that the product ordered is unavailable, BlueBird will inform the customer and refund the amount paid within a maximum of 15 days of learning of the unavailability.
BlueBird cannot be held liable in any way for any damages, direct or indirect, arising from delays in deliveries or the unavailability of the goods ordered.
To track an order in progress, the user can do so via their personal account or follow the order via https://www.bluebird.pt/pt/ajuda/tracking-de-encomendas_1022.html.
Should you not be present at the address indicated, an SMS will be sent indicating that your parcel is available for collection at the specified post office until collected. At the time of collection, simply present the SMS.
6. PAYMENT
1. BlueBird offers the user the following payment methods:
a) Credit Card (Visa, Mastercard, Eurocard and American Express);
b) Paypal
c) Klarna;
d) Google Pay;
f) Apple Pay;
e) Pagamento em 4x via FLOA.
2. Bluebird will use its best endeavours to guarantee utmost confidentiality and security of data transmitted via the Internet.
FLOA Terms and Conditions:
Pay in 4 instalments free of charge by debit or credit card with your FLOA partner.
FLOA BANK, a public limited company (société anonyme) with share capital of €72,297,200, registered with the Bordeaux trade register under number 434 130 423, registered at Bâtiment G7 - 71 Rue Lucien Faure in Boreaux (33300), FRANCE. It offers payment solutions reserved for individuals (natural persons of legal age) resident in Portugal and holders of a Visa or MasterCard bank card with an expiry date corresponding to the duration of the refund which allows them to pay for their purchases of goods and/or services, via "Payment in 4X", without interest.
Once you have completed your order, you must choose to pay using the desired payment method "Payment in 4X" by Credit Card. You will then be redirected to the FLOA BANK website, where you can make your payment. FLOA BANK reserves the right to accept or refuse the financing request; the customer may cancel the payment request within 14 days. For more information, click here.
Please note that if you request payment for your order of goods and/or services using these payment methods, your personal data will be passed on to FLOA BANK for the purposes of analysing the financing request, managing the credit agreement and, where appropriate, recovery. 7. PRICES
Prices are shown in Euros, taking into account the VAT in force on the date of payment of the order.
8. RETURNS AND EXCHANGES
1. Any order contract placed on the BlueBird website may be freely cancelled under the terms of article 6 of Decree-Law no. 143/2001, of 26 April, within a maximum period of 30 days from the date of receipt of the order by the consumer.
2. In the event of cancellation, the consumer must keep the goods so that they can be returned to BlueBird in a usable condition within 30 days of receipt.
3. If the user wishes to return the order, they should access the order history in their personal account and click on "return" in the order details. If the purchase was made without registering on the site, simply access the link sent in the order dispatch notification email.
4. The collection methods available for returns are:
a) Collection from the address indicated by the user.
b) Delivery to a BlueBird shop.
c) Shipping to the BlueBird address: the entire process is handled by the user with the carrier of their choice. The address is BlueBird SA, Rua Engenheiro Ferreira Dias, 924, 2º andar, salas E31/E35/E36, 4100-246 Porto.
The item must always be accompanied by the invoice. Returns will only be accepted for items in the same condition as they were sent.
5. Once the right of withdrawal has been exercised under the terms of paragraphs 1, 2 and 3 above, BlueBird will reimburse the consumer for the price paid at no cost to the consumer.
6. In the event of an exchange, the user may do so at any BlueBird shop, request home collection, pick-up at a pick-up point or send it to address BlueBird SA, Rua Engenheiro Ferreira Dias, 924, 2º andar, salas E31/E35/E36, 4100-246 Porto. The item must always be accompanied by the invoice. Exchanges will only be accepted for items in the same condition as they were sent.
9. AFTER-SALES SERVICES AND WARRANTY
All items sold by BlueBird until 31 December 2021 are covered by a 2-year manufacturer warranty provided by the respective brands. After this date, the warranty period is 3 years. After the warranty expires, BlueBird will also provide technical assistance. In the case of defective or faulty products, please go to your nearest BlueBird shop, taking the item and invoice with you. Whenever the repair involves costs for the customer, it will only be carried out after the customer has accepted the quote.
10. BLUEBIRD NEWSLETTER
1. The BlueBird Newsletter includes emails with offers, promotions, and information, sent to the user's email inbox provided to BlueBird on user registration. Users can subscribe to the Newsletter and will be automatically registered from the moment they place their first online order.
2. To modify your personal data, please proceed to your personal area.
11. INTELLECTUAL PROPERTY
The BlueBird website and the content it contains are protected by copyright and industrial property laws and may not be copied, reproduced, or distributed, in whole or in part. In particular, it is forbidden to copy or retransmit any text, logo, graphic, sound or image from the BlueBird website, unless expressly permitted by BlueBird.
Printing and collecting the information contained on this site for personal use is permitted.
12. LITIGATION AND LIABILITY
1. BlueBird is not responsible for any inconvenience or damage caused to the user by the use of the Internet network, such as: service disruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.
2. The law applicable to any contractual relationship established through the BlueBird website is Portuguese law.
3. To settle any and all disputes arising from any contract entered into under the terms of these general terms and conditions of sale, the Porto Court shall have jurisdiction, expressly waiving any other court.
13. TERMS AND CONDITIONS BLACK FRIDAY 2023
Discounts of up to 50% on selected women's, men's and children's jewellery and watches. Campaign valid in all BlueBird shops and at www.bluebird.pt, from 1 to 30 November 2023. Limited to existing stock. The extended exchange period remains available for all products purchased during the Black Friday campaign until 31 January 2024. Discounts of 20% or more do not accumulate with customer card discounts, nor do they count towards the issue of new vouchers.
